I acknowledge that martial arts (including, but not limited to, archery, axe throwing, swordplay, stick fighting, wrestling and combat) (“Martial Arts”) are a potentially dangerous activity. The possibility of bumps, bruises, scrapes, soreness, sprains twists, related injuries or even death is possible.

I FREELY ACCEPT AND FULLY ASSUME ALL RISKS, DANGERS, HAZARDS OF MARTIAL ARTS AND THE POSSIBILITY OF PERSONAL INJURY AND DEATH.

I acknowledge that physical contact with my child’s body is part of practicing and learning Martial Arts. The chest, buttocks, groin, or any part of their body may be contacted by any part of the class partner’s body during training of a specific technique, or incidentally contacted while performing a martial arts technique targeting another portion of the body.

I understand that Instructors may adjust or manipulate any part of my child’s body to assist in the proper application and understanding of a Martial Arts technique.

I understand and have communicated to my child their right to withdraw from any exercise or drill for any reason and at any time.

If the conduct of an instructor or training partner appears inappropriate, the parent/guardian should inform an Academie Duello Ltd. director privately. If the conduct of an instructor or any training partner appears criminal, then a director should be informed and the authorities may be notified either by the student or the director, or both.

I understand that if my child’s behaviour endangers the safety of other children during Academie Duello Ltd. activities, or if their behaviour is excessively disruptive, they may be suspended from their participation.

I agree to pick up my child within a reasonable timeframe, if my child is suspended.
In consideration of Academie Duello Ltd. allowing my child to participate in its Martial Arts classes, activities, events and other offerings and other good and valuable consideration the receipt and sufficiency I hereby agree not to bring any claim or suit against Academie Duello Ltd. and its directors, officers, employees, agents, instructors, representatives and assigns, guests, students or landlord (the “Releasees”) on behalf of my child for any injury or harm sustained by any event short of a criminal act, and then only the criminal shall be the subject of such a claim. I further agree that I will not cause to be brought, nor encourage a claim or suit. I also agree not to cooperate in the bringing of such a suit or claim except insofar as I may be legally required to do so. Finally, I shall indemnify the Releases of and all additional defendants covered by this agreement for all judgments, costs, attorney fees and other expenses incurred as a result of a breach of this agreement.

This Agreement shall be effective and binding on my heirs, next of kin, executors, administrators and representatives.

This Agreement will be governed by and interpreted in accordance with the laws of British Columbia,

I understand that if any clause, sentence, phrase or statement in this document is found unenforceable or invalid by any Court of law, the remainder of this document shall remain valid and enforceable and the invalid clause, sentence, phrase or statement shall be considered struck from the document.

In entering into this Agreement, I am not relying on any oral or written representation or statements made by the Releasees with respect to the safety of Martial Arts other than what is set forth in this Agreement.
